Catalonia has a comprehensive and very detailed consolidated planning text. If you have planning enforcement proceedings in any Catalan municipality, the reference legislation is Legislative Decree 1/2010, of 3 August, approving the Consolidated Text of the Urban Planning Act of Catalonia (TRLUC).
What the law says exactly
The TRLUC regulates the regime of planning violations and sanctions in Catalonia in Articles 196 to 228.
Limitation periods for planning violations (Article 227 TRLUC):
- Very serious violations: 6 years.
- Serious violations: 4 years.
- Minor violations: 2 years.
These periods are significantly longer than in other autonomous communities, which makes invoking the statute of limitations more difficult in Catalonia than elsewhere.
Limitation periods for sanctions (Article 227 TRLUC): 3 years (very serious), 2 years (serious), 1 year (minor).
Limitation period for the restoration of planning legality action (Articles 206–207 TRLUC): on non-developable land (not buildable), the restoration action is imprescriptible — it does not expire. On urban and developable land, the restoration action becomes time-barred at the same periods as the corresponding violation.
Classification of violations under the TRLUC: violations are classified according to severity, taking into account the value of the works, the type of land, and the impact on the plan.
Expiry of the planning legality protection proceedings: 18 months from initiation, pursuant to Article 202.1 TRLUC as amended by Legislative Decree 2/2025, of 25 February 2025.
Recent reform — DL 2/2025: Catalonia’s Legislative Decree 2/2025 introduced significant changes to the expiry deadlines for planning legality protection proceedings. It is worth checking the transitional provisions for proceedings initiated before it came into force.
Steps you can take, in order
- Identify the type of violation attributed to you under the TRLUC and determine the applicable limitation period.
- Determine the type of land (urban, developable, non-developable). The imprescriptibility of the restoration action depends on this.
- Calculate the start date of the limitation period. In Catalonia, the period generally starts from the completion of the works. [CHECK REGULATIONS]
- Verify whether the proceedings have expired. Check the dates of the procedure and whether more than 18 months have elapsed since initiation without a resolution (Article 202.1 TRLUC after DL 2/2025).
- Request the complete file and verify the basis of the sanction.
- Submit your written representations (alegaciones) within the legal deadline.
Common errors by Catalan councils
Error 1: Applying the imprescriptibility regime to developable or urban land. Imprescriptibility only applies to non-developable land in Catalonia.
Error 2: Miscalculating the start of the limitation period. In Catalonia, the starting point for the limitation period may vary depending on the type of violation.
Error 3: Confusing the limitation period for the punitive violation with the limitation period for the restoration action. These are different periods with different rules.
Error 4: Failing to respect the expiry deadline for the planning legality protection proceedings. After DL 2/2025, the deadline is 18 months (Article 202.1 TRLUC). If the proceedings exceed that period without a resolution, expiry may apply.
Anonymous real case
Teresa P. had a 25 m² home extension in a municipality in the Alt Penedès area of Catalonia. The extension was 5 years old. The violation was classified as serious (limitation period: 4 years). The limitation period had run out the year before the council opened the proceedings. We submitted written representations on limitation grounds with documentation proving the age of the works. The proceedings were archived.
Frequently asked questions
Are the limitation periods in Catalonia longer than in other autonomous communities? Yes. The 6-year period for very serious violations and 4 years for serious violations are among the longest in Spain. This makes the statute of limitations a harder argument to use in Catalonia than in other autonomous communities.
Is the restoration action on non-developable land in Catalonia truly imprescriptible? Yes, under Articles 206–207 TRLUC. On non-developable land, the restoration action does not become time-barred.
Does the TRLUC apply in the city of Barcelona? Yes. The TRLUC applies throughout Catalonia, including Barcelona, although the city has its own urban plan.
How long do I have to submit written representations in Catalan proceedings? The hearing period is that established in administrative procedure. It is usually 10 working days from notification of the statement of charges (pliego de cargos).
Can municipal by-laws in Catalonia modify the TRLUC deadlines? No. Limitation and expiry periods are established by autonomous community legislation. Municipal by-laws cannot modify them.
