What the council won't tell you

Your silence is their best ally. Three mistakes that will cost you thousands.

Most enforcement files contain technical or procedural defects. Our job is to conduct a thorough technical audit of the document and find the arguments that reduce or invalidate the penalty.

Accepting the inspector's valuation

Council measurements systematically overestimate the works. Without a professional counter-measurement, you end up paying more than the law requires.

Thinking demolition closes the case

Demolishing the pool or enclosure does not cancel the fine of €3,000–€15,000 in the enforcement file. It is a double loss: you lose the construction and your savings.

Letting the deadline decide for you

With 10–15 working days available, every day without action brings you closer to a final penalty. Not submitting an appeal is effectively validating the council's proposal by default.

Process

Three steps. No complications.

1

Tell us about your case

Send us the notification by WhatsApp or email. You don't need to prepare anything — just have the document to hand. The consultation is free.

2

We analyse the enforcement file

We review all the documentation, identify errors and give you a fixed quotation. If there are no grounds, we tell you for free.

3

Appeal documents ready

Technical and legal appeal documents adapted to your local planning regulations, ready to submit to the Spanish council in 3–5 working days.

Our approach

Specialists in Spanish planning law.

A Spanish planning enforcement case is not a generic legal dispute. It is won by auditing deadlines, technical measurements, the local planning rules (PGOU) of your municipality and the proportionality criteria applicable in your region.

Over 15 years analysing enforcement files from councils across Spain. We know how each authority operates, how enforcement files are drafted, what errors they typically make and which arguments carry weight in each type of resolution.

Real cases resolved

Cases we handle

Real situations successfully defended. Without names, with arguments.

🏊

40 m² pool — Alicante region

Fine of €8,400 for building a pool without planning permission. The council had not verified the actual age of the works.

Key argument

Prescription of the infraction due to documented age of the works.

Typical result: cancellation or significant reduction of the penalty.

🏗️

Terrace enclosure — Seville

Fine of €3,600 + demolition order for an enclosed terrace. The inspector's technical valuation did not comply with the applicable regulations.

Key argument

Error in the technical valuation: floor area overestimated and proportionality criteria ignored.

Typical result: fine reduced and demolition order suspended.

🧱

25 m² extension — Valencia

Fine of €12,000 for an extension without planning permission. The original notification had formal defects that rendered it invalid.

Key argument

Formal defect in the notification: failure to comply with Art. 40 of Ley 39/2015.

Typical result: declaration of nullity of the proceedings.

Frequently asked questions

Your questions answered

How much does the service cost?
The initial consultation and viability review are completely free. Fixed-fee plans start from €299+VAT up to €999+VAT depending on the type of case. In the vast majority of cases, the reduction achieved far exceeds the cost of the service.
Can a Spanish planning fine really be reduced?
We cannot promise a specific outcome, but in the vast majority of enforcement files we find procedural errors, proportionality criteria that have not been applied, or mandatory mitigating factors. If we do not find solid grounds, we tell you before issuing any quote.
Can submitting an appeal make my situation worse?
No. Submitting an appeal is a right under Spanish administrative procedure. Not submitting one does not close the case — it simply means the council resolves it without hearing your side. Not submitting an appeal is the most expensive option, not the safest.
How long do I have to act?
Normally between 10 and 15 working days from notification. It is a tight deadline but sufficient if we act quickly. We deliver appeal documents in 3–5 working days. For urgent cases we offer delivery in 24–48 hours.
What do I need to get started?
Just the notification from the Spanish council — a photo or scan is fine. That is all we need for the initial free assessment. If you have additional documents (plans, photographs) they are useful but not essential to get started.
