Planning Infringements in Castilla y León: LUCyL (Law 5/1999) and Current Legislation

In this article

Castilla y León is Spain’s largest autonomous community, with a wide variety of planning situations. The reference legislation is Law 5/1999, of 8 April, on Urban Planning in Castilla y León (LUCyL), substantially amended by Law 7/2014, and developed by Decree 22/2004, of 29 January, approving the Urban Planning Regulations of Castilla y León.

What the law actually says

The LUCyL and its implementing legislation govern the regime of planning infringements and sanctions in Castilla y León.

Limitation periods for infringements (Article 121 LUCyL):

  • Very serious infringements: 10 years.
  • Serious infringements: 8 years.
  • Minor infringements: 4 years.

Restoration of legality (Article 114.2 LUCyL): the same periods as for the limitation of infringements (10/8/4 years depending on seriousness).

Imprescriptibility: green areas, open spaces, public domain, catalogued heritage assets, rural land with natural or cultural protection.

Lapse of enforcement proceedings: the lapse period for enforcement proceedings in Castilla y León is that established by the regional legislation, supplemented on a subsidiary basis by the LPACAP. [LEGAL NOTE: verify the specific period in the LUCyL or Decree 22/2004]

A distinctive feature of Castilla y León is the regulation of rural heritage, particularly relevant for buildings in rural settings that may have architectural or historical value.

Steps you can take, in order

  1. Identify the type of infringement according to the LUCyL and the applicable limitation period (Article 121 LUCyL).
  2. Determine the type of land and verify whether imprescriptibility applies.
  3. Calculate the start date of the limitation period. [LEGAL NOTE: verify the exact criterion in the LUCyL]
  4. Verify the lapse of proceedings by checking the procedural dates.
  5. Request the complete case file to verify the basis for the sanction.
  6. Submit written representations within the legal deadline.

Common errors made by councils in Castilla y León

Error 1: Applying limitation periods different from those in Article 121 LUCyL. The correct periods are 10/8/4 years (VS/S/M). Applying shorter periods unduly benefits the administration and prejudices the rights of the person under investigation.

Error 2: Failing to distinguish between rural land with protection and without protection. The imprescriptibility regime only applies to the categories expressly provided for (green areas, public domain, catalogued heritage assets, rural land with natural or cultural protection).

Error 3: Incorrectly calculating the limitation period by applying the general period without verifying the type of infringement.

Error 4: Failing to verify the possibility of legalisation before issuing the demolition order. On urban land, many works can be legalised.

Anonymous real-life case

Ricardo P. had a 12 m² garden shed on his property on the outskirts of Valladolid. The infringement was classified as minor. The regional legislation set a limitation period of 4 years for minor infringements (Article 121 LUCyL). The limitation period had fully expired by the time the council opened the proceedings (more than 5 years after construction). We submitted written representations on the grounds of limitation. The proceedings were closed.

Frequently asked questions

Is Law 5/1999 the legislation in force in Castilla y León? Yes. Law 5/1999 on Urban Planning in Castilla y León (LUCyL), as subsequently amended including the reform introduced by Law 7/2014, is the current reference legislation. Its implementing regulations are in Decree 22/2004.

Are the limitation periods in Castilla y León longer than in other autonomous communities? Yes, they are among the longest in Spain: very serious 10 years, serious 8 years, minor 4 years (Article 121 LUCyL). This makes limitation a harder argument to rely on in this community.

Is the restoration action on specially protected rural land in Castilla y León imprescriptible? Only for rural land with natural or cultural protection, as well as green areas, open spaces, public domain, and catalogued heritage assets. [LEGAL NOTE: verify the exact article in the LUCyL]

Do Municipal Planning Rules in Castilla y León have the same status as a General Urban Plan? In many small municipalities in Castilla y León there is no General Urban Plan but rather Municipal Planning Rules (NUM). These have regulatory status equivalent to the General Urban Plan for the matters they regulate.

How long do I have to submit written representations in Castilla y León? The hearing period is that established in the administrative procedure. Typically 10 working days from notification of the statement of charges, in accordance with the LPACAP.
