Aragón’s reference legislation for planning enforcement proceedings is the Legislative Decree 1/2014, of 8 July, of the Government of Aragón, which approves the Consolidated Text of the Planning Law of Aragón (TRLUA). The TRLUA has been amended by Law 2/2023.
What the law actually says
The TRLUA regulates the planning infringement and penalty regime in Aragón in Chapter III of Title VI, Articles 277–287. [LEGAL CHECK: verify exact articles]
Limitation periods for infringements (Article 284 TRLUA):
- Very serious infringements: 10 years.
- Serious infringements: 4 years.
- Minor infringements: 1 year.
Specially protected non-developable land: in Aragón, actions on specially protected non-developable land may be subject to an imprescriptible restoration action. [LEGAL CHECK: verify exact article in TRLUA]
Expiry of proceedings: the expiry period for enforcement proceedings in Aragón is set by the TRLUA, supplemented on a subsidiary basis by the LPACAP. [LEGAL CHECK]
A particular feature of Aragón is the extensive area of rural land in the Pyrenees and the Iberian mountain range, with specific protection regimes belonging to Irrigation Communities and natural spaces.
Steps you can take, in order
- Identify the type of infringement under the TRLUA and the applicable limitation period (Article 284 TRLUA).
- Establish the land classification and check whether the imprescriptibility applies.
- Check how long ago the works were done and whether the infringement has expired.
- Check whether the proceedings have expired by exceeding the maximum period.
- Assess whether legalisation is possible if the works are compatible with the planning framework.
- Submit written representations within the legal time limit.
Common errors made by Aragonese councils
Error 1: Not distinguishing between generic non-developable land and specially protected non-developable land. The difference affects the limitation period for the restoration action.
Error 2: Applying incorrect limitation periods. The periods under Article 284 TRLUA are 10/4/1 years (VS/S/M). Periods such as “4/2/6 months” or “3/2/1” are incorrect.
Error 3: Not checking whether legalisation is possible before issuing a demolition order.
Error 4: Not respecting the expiry period of the proceedings.
Anonymous real-life case
Jorge F. had a 30 m² garage at his property on the outskirts of Zaragoza. The enforcement proceedings were opened 5 years after the construction. The infringement was classified as serious. The regional regulations set the statute of limitations for serious infringements at 4 years (Article 284 TRLUA). The limitation period had already run before the council opened proceedings. We submitted representations arguing the statute of limitations. The proceedings were closed.
