Planning Discipline in La Rioja: LOTUR (Law 5/2006) and Its Particularities

La Rioja, despite its small size, has its own planning legislation with its own particular features. The reference legislation is Law 5/2006, of 2 May, on Land Use Planning and Urban Development of La Rioja (LOTUR).

What the law says exactly

LOTUR regulates the regime of planning infractions and sanctions in La Rioja in its Title VII, Articles 198 onwards.

Limitation periods for infractions (Article 219.1 LOTUR):

  • Very serious and serious infractions: 4 years (both very serious and serious treated equally).
  • Minor infractions: 1 year.

Lapse of enforcement proceedings (Article 225.6 LOTUR): 1 year from initiation.

Non-developable land with special protection: in La Rioja, actions on specially protected non-developable land may have an imprescriptible restoration action.

A particular feature of La Rioja is the protection of vineyard landscapes, especially in the DOCa Rioja designated areas, where interventions on rural land face additional restrictions linked to the preservation of the wine-growing landscape.
